It would seem that most stores are doing this, but if you read the small print, they shouldn't.
If it doesn't work for you, don't kick up a fuss, 'cos you are in the wrong.

The firmware version on the iPod will be 1.1.5.
The latest version is 2.1 but Apple will charge you £5.99 for the pleasure.

If you connect your Ipod to your P.C. and wait for it to link up with Itunes (Assuming you have installed the latest version) you should see that it offers you a chance to restore the version of firmware you have. ( Middle of screen, slightly to the right )
If you hold down the shift key and click restore, it will ask you for a file ending in .ipsw to restore to. So now you know the firmware file ends in ipsw ( As your Ipod told you ).
If you could find version 2.0 of this file ( Use your favourite search engine ) and restore to that file, the next time you reboot your Ipod, it should recognise that you have version 2.0 and it will offer you version 2.1 from Apple for free.
This way, your firmware is finally updated by Apple rather than any D.I.Y. method.
